In order to do so, Rabinowitz, Lubetkin & Tully, acting often on short notice, advanced extremely aggressive legal positions before the Bankruptcy Court, District Court and, ultimately, the Third Circuit Court of Appeals, where it was successful in obtaining an emergent stay of a bankruptcy court approved sale of the property to an extremely hostile real estate speculator that would likely have moved to evict RLT’s client as soon as he took title. The stay obtained by Rabinowitz, Lubetkin & Tully eventually resulted in the casino being sold “subject to” its client’s rights at the premises and protected its $16 million investment.
